Chunky Butt Cookies / Chunky Butt Bakery – Terms and Conditions of Sale

1. Acceptance of Terms

By placing an order with Chunky Butt Cookies or Chunky Butt Bakery (collectively, “Seller”), the purchaser (“Customer”) agrees to be bound by these Terms and Conditions of Sale. These terms govern all sales, shipping, and handling of goods purchased from Seller.

2. Perishable Goods; All Sales Final

Customer acknowledges that the products sold by Seller are fresh, perishable baked goods. Due to the nature of these goods, all sales are final. Seller does not accept returns, exchanges, or cancellations under any circumstances.

3. Shipping, Delivery, and Handling

• Seller ships all orders via United States Postal Service (USPS), using priority delivery by default.
• Customer is solely responsible for delivery of the order. Seller shall not be liable for any loss, damage, delay, or failure caused by USPS or any other third-party shipping provider.
• Customers may request faster shipping options, including overnight delivery, at an additional cost. Customer is responsible for paying any such additional fees.
• Local delivery within Texas (including Frisco, Prosper, Little Elm, Highland Park, University Park, and other areas) incurs variable delivery fees based on location and requested delivery day. Customer is responsible for reviewing, confirming, and paying the applicable local delivery fee when scheduling delivery.
• Local deliveries must be scheduled using Seller’s delivery calendar system, and delivery is only available for the days listed on the calendar. Customer is responsible for selecting the correct day and time for delivery.
• Customer is responsible for providing an accurate delivery address and ensuring someone is available to receive the delivery.

4. Returns & Payment Policy

• No Returns: Due to safety and the perishable nature of our products, Seller does not accept returns under any circumstances.
• No Refunds or Chargebacks: All sales are final. Customer agrees that no refunds, credits, or reimbursements will be provided for any reason. No chargebacks of any kind are permitted, including via PayPal, Apple Pay, Google Pay, Visa, MasterCard, debit cards, or any other payment method.
• Customer Responsibility:
   
  • Please verify your order carefully before submission.
  • Do not use anyone else’s credit or debit card. All payments must be authorized by the cardholder.
  • Ensure that your shipping address is correct.
• Seller Safeguards:
   
  • All products are freshly baked, securely packaged, and tracked.
  • Seller takes photographs and handoff records to ensure proper delivery.
  • Packages are wrapped to maintain integrity and prevent tampering during transit.

5. Payment Methods

Seller accepts payment only through Google Pay, Apple Pay, and PayPal. All transactions processed through these platforms are final and binding.

6. Customer Acknowledgment

By completing a purchase, Customer acknowledges understanding and acceptance of the foregoing Terms and Conditions. Customer further acknowledges responsibility for all orders, including applicable delivery fees, proper use of payment methods, and acceptance of the no returns, no refunds, and no chargeback policy.

7. Limitation of Liability

To the fullest extent permitted by law, Seller shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to lost or damaged shipments, delays, or issues caused by USPS, local delivery, or any third-party carrier.

8. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
